Cosy House Collection Accessibility Terms of Service
1. Purpose and Scope
These Accessibility Terms of Service (“Accessibility Terms”) set forth Cosy House Collection’s commitments and limitations regarding accessibility in relation to its digital properties, including websites, mobile applications, and other e-commerce platforms operated under the Cosy House Collection brand within the European Union (“EU”).
These Accessibility Terms are intended to address compliance with applicable European Union legislation, including Directive (EU) 2019/882 (the “European Accessibility Act” or “EAA”), as transposed and enforced in Member States, and any related standards such as EN 301 549.
These Accessibility Terms apply solely to digital services directly operated by Cosy House Collection. They do not extend to any physical goods sold, nor to third-party integrations, services, or content outside of Cosy House Collection’s reasonable control.
2. Compliance Framework
Cosy House Collection endeavors to align its digital services with:

The requirements of the EAA as of 28 June 2025;

The relevant provisions of EN 301 549 (which incorporates WCAG 2.1 Level AA criteria); and

Any additional mandatory accessibility obligations imposed by applicable national law.
No Guarantee of Full Compliance. While Cosy House Collection takes reasonable measures to meet these requirements, Cosy House Collection does not represent or warrant that its services are fully accessible in all respects, at all times, on all platforms, or in conjunction with all assistive technologies.
3. Limitations of Responsibility
Without prejudice to applicable law, Cosy House Collection expressly disclaims responsibility for accessibility issues arising from:

Third-Party Content or Services: Plug-ins, payment processors, embedded media, maps, or other external tools or content not developed or maintained by Cosy House Collection;

User Devices or Software: Incompatibilities due to outdated browsers, unsupported operating systems, or assistive technologies outside current industry standards;

Legacy Materials: Archived or historical content predating current accessibility standards;

Disproportionate Burden: Any requirement that imposes a legally recognized disproportionate burden on Cosy House Collection, taking into account technical feasibility, available resources, and market conditions.
4. Feedback and Contact Procedure
Cosy House Collection maintains a channel for users to submit accessibility-related feedback or requests. Submissions may be made via email at accessibility@cosyhousecollection.eu

Cosy House Collection will review such feedback within a reasonable timeframe but is not obligated to take any specific remedial action unless required by applicable law.

Cosy House Collection may, at its discretion, provide alternative means of access to content where feasible.

Communications must be made in good faith; Cosy House Collection reserves the right to disregard or decline unreasonable or abusive requests.
5. Monitoring and Review
Cosy House Collection undertakes periodic internal reviews of its digital services against applicable standards. Such reviews are conducted on a best-efforts basis and do not constitute a warranty of compliance. Cosy House Collection may update or amend its accessibility measures at its sole discretion, subject to applicable legal requirements.
6. Enforcement and Remedies
Nothing in these Accessibility Terms shall be construed to create contractual rights in favor of users or third parties. Users retain any rights and remedies provided under applicable law, including the right to lodge complaints with designated national enforcement bodies.
To the fullest extent permitted by law, Cosy House Collection shall not be liable for indirect, incidental, consequential, or punitive damages arising from accessibility-related issues, including but not limited to loss of use, lost profits, or reputational harm.
7. Reservation of Rights
Cosy House Collection reserves the right to:

Modify or withdraw any digital feature, service, or content, including accessibility-related features, without prior notice;

Rely on legal exemptions or limitations provided under the EAA or national law, including disproportionate burden provisions;

Update these Accessibility Terms at any time to reflect changes in law, technology, or business practices.
8. Governing Law
These Accessibility Terms shall be governed by and construed in accordance with the laws of Belgium, without prejudice to mandatory consumer protection provisions applicable in a user’s country of residence within the EU.
9. Last Updated
These Accessibility Terms were last updated on 9 September 2025 and supersede all prior statements or policies relating to accessibility issued by Cosy House Collection.
10. Dispute Resolution
10.1 Negotiation and Internal Escalation
Any dispute, claim, or controversy arising out of or relating to these Accessibility Terms, or to accessibility measures or obligations of Cosy House Collection generally (collectively, “Accessibility Disputes”), shall first be submitted in writing to Cosy House Collection at legal@cosyhousecollection.eu. The parties shall make reasonable efforts to resolve the matter amicably through good-faith negotiations within 30 calendar days of notice.
10.2 Arbitration
If an Accessibility Dispute is not resolved through negotiation within the above timeframe, it shall be finally settled by binding arbitration under the Rules of Arbitration of the International Chamber of Commerce (“ICC”) in effect at the time of the dispute, by one arbitrator appointed in accordance with said Rules.

Applicable Law: The laws of Belgium, without prejudice to mandatory EU consumer protection laws applicable to the user’s residence.
The arbitration award shall be final and binding on the parties and enforceable in any competent court.
10.3 Court Proceedings
Notwithstanding the above, Cosy House Collection reserves the right to initiate proceedings in the competent courts of Belgium (or, where required, in the courts of the EU Member State of the consumer’s habitual residence) in order to:

seek injunctive relief,
-
enforce intellectual property rights, or
-
recover unpaid amounts owed.
10.4 Waiver of Class Actions
To the maximum extent permitted by law, all Accessibility Disputes shall be conducted only on an individual basis and not in any class, collective, consolidated, or representative action.
10.5 Limitation of Claims
Any Accessibility Dispute must be brought within twelve (12) months after the cause of action accrues. After this period, such claims shall be permanently barred, unless a longer period is mandatorily required by law.
